The Environmental Protection Agency (EPA) is proposing two major rules regarding development and siting of large combined heat and power (CHP) facilities. The first rule, the CHP rule, proposes to establish conditions under which states and tribes may require large CHP combustion engine units (CEUs) be constructed and located within their jurisdiction as part of a broad effort to achieve additional electricity from renewable and landfill gas sources. The second proposed rule, the Minerals Fuel Standard Rule (MFSR) would expand federal standards for biofuel content in transportation fuels used in place of or in addition to petroleum-based fuels, and require a certain minimum percentage of biofuel use by 2030. The final rules are open for a 45-day public comment period. The public comment period began on October 19, 2011, and will remain open until November 19, 2011. During that period, EPA requests that comments be sent by email to the email address listed below. Commenters are encouraged to submit their comments using the Comments to the Agency page, rather than to individual rulemakings.

Public participation plays an important part in EPA’s rulemaking process. EPA strives to provide a public forum where interested parties can identify issues they believe must be considered during rulemaking proceedings. We encourage all interested parties to participate through the notice of proposed rulemaking (NPRM) process (i.e., by submitting comments) by submitting comments in the period prescribed or by submitting public hearings, if applicable, as the agency conducts rulemaking. Public or small business entities, which are economically impacted by proposed or final rules, can be granted an expedited public review period or a reduced notice-and-comment period if they request help to prepare their comments. EPA provides access to a wide range of regulations through two separate online information systems, one for Finding of Significant Controversy (FONSI) and the other for Clean Air Act (CAA) Rules and Regulations. The FONSI system is designed to help the public identify potential regulatory resources. This online system will be an important tool in providing interested parties with information about FONSI rules and FONSI related regulations. This system will begin as a pilot project, beginning at this time, and other information sources will be used as appropriate to guide EPA development of the FONSI system
