Government employees with security clearances are getting their most basic rights taken away from them. Every day, this happens with little oversight from Congress, the president, or the judicial branch. This happens to no one in a federal agency that I know of.
Based on recent decisions from the Department of Homeland Security’s Office of Personnel Management, citizens may be notified their sensitive background information will be shared with third parties without their permission. This information, that is meant to be kept private and confidential, will no longer be subject to privacy laws because it is the property of an employer, not a citizen.
In one case that I have been involved with as a legal counsel, my client’s background information was shared with another law firm while being represented by the government. This information, that would have never been known had my client not contacted an attorney, was shared without his permission and without being a subject of an investigation.
Background check companies like Monster, CareerBuilder, and OKCupid have been able to access your background information for years. In certain cases, it is believed that states have used Social Security numbers stolen by data breaches to target citizens, all without a law enforcement investigation. The fact that some of this information is being held in perpetuity has given rise to the concern that this information will be used by foreign governments for their own security threats.
The responsibility of a security clearance holder is to protect all other citizens with that clearance. Without an investigatory finding, a background check is not supposed to be granted access to a new position of power.
Perhaps you are an experienced government employee who has become familiar with the Freedom of Information Act. The focus of your life in government is to serve the people and ensure that all employees are protected from the will of an elected (or un-elected) official.
